By downloading or using Sphinx Safe, you agree to these Terms of Service. The most important things to understand: we cannot recover your data if you forget your passcode, and all encryption happens on your device — we have no access to your files under any circumstances.
1. Acceptance of Terms
By downloading, installing, or using Sphinx Safe ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App.
2. Description of the App
Sphinx Safe is a private, encrypted file storage application for iOS. The App allows you to store photos, videos, files, and other content on your device using AES-256-GCM encryption. All encryption and decryption occurs locally on your device. We operate no servers, collect no data, and have no ability to access your stored content.
3. Your Passcode — Critical Notice
Your passcode is the sole key to your encrypted data. If you forget or lose your passcode, your data cannot be recovered — by you, by us, or by anyone else. There is no reset mechanism, no backdoor, and no recovery option. This is by design.
By using the App you acknowledge and accept that:
- You are solely responsible for remembering and safeguarding your passcode
- We have no ability to recover, reset, or bypass your passcode
- Forgetting your passcode will result in permanent, unrecoverable loss of all data stored in that safe
- We are not liable for any data loss resulting from a forgotten or lost passcode
4. Backup & Data Loss
The App offers optional iCloud backup and local backup file (.vaultbak) export features. You are solely responsible for maintaining your own backups. This includes responsibility for where and how backup files are stored. A .vaultbak file exported to an unsecured location — such as an unencrypted cloud service, an email, or a shared drive — may be accessible to third parties. While the backup file itself is encrypted and requires your passcode to restore, you are solely responsible for the security of the locations where you choose to store it. We are not liable for any data exposure or loss resulting from insecure backup storage practices. We make no guarantee that backups will be complete, uncorrupted, or restorable. We are not liable for any data loss resulting from failed, incomplete, or corrupted backups, device failure, accidental deletion, or any other cause.
If you delete the App, all safe data stored on your device will be permanently deleted. This action cannot be undone.
5. Acceptable Use
You agree to use Sphinx Safe only for lawful purposes. You agree not to use the App to store, transmit, or distribute any content that:
- Violates any applicable local, state, national, or international law or regulation
- Infringes on the intellectual property rights of any third party
- Constitutes child sexual abuse material or any content that exploits or harms minors
- Is used in furtherance of any criminal activity
We reserve the right to terminate your access to the App if we become aware of any violation of these terms, to the extent we are able to do so given the encrypted and private nature of the App.
6. In-App Purchases
Sphinx Safe offers a one-time lifetime unlock purchase processed through Apple's App Store. By completing a purchase you agree to Apple's payment terms. All purchases are final. We do not offer refunds except as required by Apple's refund policy or applicable law. The lifetime purchase grants you access to all current premium features. We reserve the right to add new features in the future that may require an additional purchase, though we will not remove features you have already unlocked.
A free trial period is available upon first install. The duration of the trial is subject to change for new users at any time.
7. Intellectual Property
The App, including its design, artwork, mascot characters, code, and all associated content, is owned by us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal iOS device. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the App.
8. Disclaimer of Warranties
Sphinx Safe is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure. No security system is impenetrable and we cannot guarantee that the App will never be compromised.
9. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of privacy, arising out of or related to your use of the App — even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. As described in the Privacy Policy, we collect no personal data, usage data, or any other information from you.
11. Updates to the App
We may release updates to the App from time to time. Updates may add features, fix bugs, or change functionality. We reserve the right to discontinue the App or any feature at any time. We will not intentionally remove features that users have paid to unlock.
12. Termination
These Terms remain in effect as long as you use the App. You may terminate these Terms at any time by deleting the App from your device. We reserve the right to terminate your license to use the App if you violate these Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Utah.
14. Changes to These Terms
We reserve the right to update these Terms at any time. If we make material changes we will update the effective date below. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
